Texas health insurance "catch 22"

Q:
My daughter's COBRA coverage lapsed for accidental late payment and the company will not reinstate the coverage. The Texas High risk pool says she is not eligible for another year until the date that the COBRA coverage was supposed to end. She is an insulin dependant diabetic.
